Chapter 13 of the U. S. Bankruptcy Code & Qs & As

 

Learning objectives for this roundtable include:

  • The U.S. Bankruptcy Code: Organization of the various Chapters of the Code and the Federal Rules of Bankruptcy Procedure. Effect of Local Rules.
  • Eligibility for Chapter 13: Discussion of the debt limit and special provisions for serial filing.
  • The Automatic Stay and Exceptions: Discussion of which actions are stopped—even without notice. Discussion of exceptions to the sweeping language in the automatic stay.
  • Adequate protection: How can you protect your collateral despite the automatic stay?
  • Plans and Confirmation: What can happen to a creditor’s rights in a plan
  • Discharge: Which debts are discharged? Which are not? Which require a timely objection?
